These Terms of Use (the "Terms") are a legal agreement between you and Mosaic Voice LLC ("Mosaic Voice," "we," "us," or "our"). These Terms govern your access to and use of Mosaic Voice AAC, mosaicvoiceaac.com, and any related applications, websites, products, content, features, and services that link to these Terms (collectively, the "Service").

By accessing or using the Service, creating an account, creating or managing a profile, or otherwise indicating acceptance, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

You must be legally capable of entering into a binding agreement to use the Service. Mosaic Voice accounts are adult-owned accounts. Children may not create or control Mosaic Voice accounts.

If you create or manage a child profile, you represent and warrant that you are the child's parent, legal guardian, or other adult caregiver with authority to create and manage that profile, provide the information submitted, consent to the applicable data practices, and use the Service for or with that child.

Mosaic Voice is an Augmentative and Alternative Communication support tool designed to help users communicate through visual cards, boards, categories, phrase generation, audio output, profile context, and related features.

The Service is not a medical device, emergency service, diagnostic tool, treatment plan, clinical service, legal advice, or substitute for professional judgment. You are solely responsible for determining whether and how the Service should be used in any particular communication, educational, caregiving, medical, therapeutic, or other context.

You are responsible for maintaining the confidentiality of your account credentials, restricting access to your devices, and all activity that occurs under your account. You must provide accurate account and profile information and keep it reasonably current.

If you create or manage a child profile, you are responsible for the accuracy, appropriateness, legality, and completeness of child profile information, caregiver-entered notes, uploaded content, custom cards, feedback, and any other materials you provide. You are also responsible for reviewing, updating, correcting, or deleting child-profile data when appropriate.

You may not create a child profile, upload information about a child, or enable backend generation for a child profile unless you have the legal authority to do so and have reviewed the applicable notices.

The Service is currently in beta and preparing for public launch. Beta features, availability, usage limits, pricing, subscription access, supported platforms, and launch plans may change at any time with or without notice.

Beta access may be modified, suspended, limited, or discontinued at any time. We may reset, remove, migrate, or change beta data, accounts, features, or settings as reasonably necessary to operate, secure, test, or prepare the Service for launch, subject to applicable law.

Paid Mosaic Voice Pro access is expected to use app-store billing and RevenueCat-backed subscription state. If paid subscriptions are made available, purchases, cancellations, renewals, refunds, trials, taxes, billing disputes, and payment methods may be governed by the applicable Apple App Store, Google Play, or other authorized platform terms in addition to these Terms.

Unless otherwise stated by the applicable platform, subscriptions may automatically renew until canceled. You are responsible for managing or canceling subscriptions through the applicable store account. Deleting the app, deleting a Mosaic Voice account, or deleting a child profile does not automatically cancel a subscription.

We may change prices, plan features, trial availability, usage limits, or subscription terms prospectively to the extent permitted by law and applicable platform rules.

"User Content" means information, materials, text, images, prompts, profile notes, custom cards, uploaded media, feedback, and other content that you submit, upload, transmit, store, or otherwise provide through the Service.

You retain any rights you have in your User Content. You grant Mosaic Voice a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, process, transmit, display, modify, create derivative works from, and otherwise use your User Content solely as reasonably necessary to provide, operate, secure, support, personalize, analyze, and improve the Service and to comply with law.

You represent and warrant that you have all rights, consents, permissions, and authority necessary to provide User Content and grant the license above, and that your User Content and use of the Service will not violate any law or infringe, misappropriate, or otherwise violate any rights of any person or entity.

The Service may generate phrases, text, audio, symbols, or other output using artificial-intelligence systems. AI-generated output may be inaccurate, incomplete, offensive, unexpected, unsuitable, or similar to output provided to or generated for other users.

You are responsible for reviewing AI-generated output before using, sharing, or relying on it. You must not rely on AI-generated output for emergencies, medical decisions, legal decisions, safety-critical communications, or other high-risk circumstances where inaccurate output could cause harm.

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to, and not to assist anyone else to:

• use the Service in any way that violates applicable law, regulation, platform rule, or third-party right
• exploit, harm, harass, abuse, endanger, or attempt to exploit, harm, harass, abuse, or endanger any child or other person
• submit unlawful, defamatory, obscene, abusive, hateful, violent, deceptive, infringing, or otherwise objectionable content
• impersonate another person or misrepresent your identity, authority, affiliation, or caregiver relationship
• access or use another person's account, profile, data, or device without authorization
• reverse engineer, decompile, disassemble, scrape, crawl, copy, modify, or create derivative works of the Service except to the extent such restriction is prohibited by law
• interfere with, disrupt, overload, damage, disable, or impair the Service or any server, network, system, or security measure
• introduce malware, harmful code, automated abuse, denial-of-service attacks, credential stuffing, or other malicious activity
• use the Service to develop competing products or to train, benchmark, or evaluate models or systems without our prior written consent
• remove, obscure, or alter proprietary notices or attempt to circumvent access controls, usage limits, subscription controls, or security features

The Service, including its software, interfaces, designs, text, graphics, logos, trademarks, service marks, trade dress, content, and all related intellectual-property rights, is owned by Mosaic Voice or its licensors and is protected by applicable intellectual-property and other laws.

Subject to your compliance with these Terms, Mosaic Voice grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for its intended purpose. No rights are granted except as expressly stated in these Terms.

The Service may include, depend on, or link to third-party services, software, SDKs, platforms, content, models, stores, or materials. Third-party services may be subject to separate terms and privacy policies. Mosaic Voice is not responsible for third-party services that it does not control.

Your use of Apple, Google, RevenueCat, Auth0, AI providers, or other third-party services may be governed by their separate terms, policies, and platform rules.

If you provide suggestions, comments, ideas, improvements, or other feedback about the Service, you grant Mosaic Voice a perpetual, irrevocable, worldwide, royalty-free right to use, disclose, reproduce, modify, license, distribute, and otherwise exploit that feedback without restriction or compensation to you.

We may suspend, restrict, or terminate your access to the Service, remove content, disable profiles, or take other action if we believe you have violated these Terms, created risk or possible legal exposure, infringed third-party rights, threatened the security or integrity of the Service, or used the Service in a way that may harm another person.

You may stop using the Service at any time. Account, profile, and subscription deletion or cancellation are subject to the procedures described in the Service, this website, the Privacy Policy, and applicable app-store rules.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS," "AS AVAILABLE," AND WITH ALL FAULTS. MOSAIC VOICE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, RELIABILITY, AND COURSE OF DEALING OR USAGE OF TRADE.

MOSAIC VOICE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, ACCURATE, COMPLETE, COMPATIBLE WITH EVERY DEVICE OR COMMUNICATION NEED, OR FREE FROM HARMFUL COMPONENTS. MOSAIC VOICE DOES NOT WARRANT THAT AI-GENERATED OUTPUT WILL BE ACCURATE, APPROPRIATE, UNIQUE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOSAIC VOICE AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, ENHANCED, OR PUNITIVE DAMAGES, LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER OR DEVICE DAMAGE, OR COST OF SUBSTITUTE SERVICES ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOSAIC VOICE'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO MOSAIC VOICE FOR THE SERVICE IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US $100). THE FOREGOING LIMITATIONS APPLY TO ALL THEORIES OF LIABILITY, WHETHER BASED IN WARRANTY, CONTRACT, STATUTE, TORT, STRICT LIABILITY, NEGLIGENCE, OR OTHERWISE.

Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, the limitations above apply only to the maximum extent permitted by law.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Mosaic Voice and its affiliates, directors, officers, employees, contractors, agents, licensors, and service providers from and against any claims, damages, liabilities, losses, judgments, awards, settlements, costs, expenses, and fees, including reasonable attorneys' fees, arising out of or relating to your use of the Service, your User Content, your violation of these Terms, your violation of law, your infringement or misappropriation of third-party rights, or your creation or management of any profile without proper authority or consent.

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

Subject to any mandatory rights you may have under applicable law, you agree that any legal action or proceeding arising out of or relating to these Terms or the Service will be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction and venue of those courts.

We may update these Terms from time to time. The updated date above indicates when these Terms were last revised. Changes are effective when posted unless a later effective date is stated. Your continued use of the Service after updated Terms are posted means you accept the updated Terms.

These Terms, together with any terms incorporated by reference, constitute the entire agreement between you and Mosaic Voice regarding the Service. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms is not a waiver of that provision. You may not assign or transfer these Terms or your rights or obligations under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or operation of law.
