Reporting Claims of Copyright Infringement

Mosaic Voice respects intellectual-property rights and expects users of the Service to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law, including the Digital Millennium Copyright Act, 17 U.S.C. Section 512 (the "DMCA").

If you believe that material available through the Service infringes your copyright, you may submit a written DMCA notice to our designated copyright agent. The notice should include substantially the following information:

  • your physical or electronic signature
  • identification of the copyrighted work claimed to have been infringed or, if multiple works are covered by a single notice, a representative list of those works
  • identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate the material
  • your name, mailing address, telephone number, and, if available, email address
  • a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • a statement that the information in the notice is accurate
  • a statement, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

If a DMCA notice does not substantially comply with the requirements of 17 U.S.C. Section 512(c)(3), it may not be effective. If you knowingly materially misrepresent that material or activity is infringing, you may be liable for damages, including costs and attorneys' fees, under 17 U.S.C. Section 512(f).

Counter Notification Procedures

If you believe material you posted was removed or disabled by mistake or misidentification, you may submit a written counter notification to the designated copyright agent above. The counter notification should include substantially the following information:

  • your physical or electronic signature
  • identification of the material that was removed or disabled and the location where the material appeared before it was removed or disabled
  • your name, mailing address, telephone number, and, if available, email address
  • a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification
  • a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which Mosaic Voice may be found, and that you will accept service of process from the person who submitted the DMCA notice or that person's agent

The DMCA permits us to restore removed material if the party that submitted the original DMCA notice does not file a court action against you within the period specified by the DMCA after receiving a copy of your counter notification.

Repeat Infringers

It is our policy, in appropriate circumstances, to disable or terminate accounts or access for users who are repeat infringers.
